1.1 User: Any person who enters into an agreement with Dobber and/or uses a Kayak or SUP rented out by Dobber.
1.2 Dobber: The company Dobber, registered under enterprise number 1005.783.595, located at Kortrijksesteenweg 689B, 9000 Ghent, Belgium. Reachable via email at ahoy@dobber.life.
1.3 Personal Data: All data provided by the user to Dobber within the framework of the user agreement.
1.4 Rental Period: The period during which the equipment is made available by Dobber to the user.
1.5 Equipment: All items made available by Dobber to the user, including but not limited to kayaks, SUPs, paddles, life vests, and waterproof bags.
1.6 Voucher: A digital or physical document worth a certain amount that can be exchanged for services provided by Dobber.
2.1 These general terms and conditions apply to all legal relationships between Dobber and every user concerning the services offered by Dobber. The user's terms and conditions do not apply.
2.2 All provisions in these general terms and conditions have also been drawn up for the benefit of all Dobber directors and all persons working for Dobber and/or engaged by Dobber.
2.3 Deviations from these general terms and conditions are only valid if expressly agreed upon in writing by both parties.
2.4 Users will be notified of changes to these general terms and conditions via email. The amended terms will be deemed agreed upon as soon as the user re-confirms their agreement to the terms during a subsequent reservation. These can be consulted at any time via https://www.dobber.life/algemene-voorwaarden.
2.5 The general terms and conditions are accepted when making a reservation via the Dobber website. No reservation can be made without checking the box for the general terms and conditions.
2.6 Dobber's general terms and conditions apply to all future transactions, including rental agreements communicated verbally, by phone, by email, or via other electronic means.
2.7 Deviating terms from the user have no legal force unless explicitly accepted by Dobber in writing.
2.8 Dobber is only bound to execute any agreement after providing a written order confirmation to the user.
2.9 The invalidation of an article or clause shall never entail the invalidity of the entire general terms and conditions.
2.10 Objections or comments regarding the general terms and conditions can be submitted in writing via email to ahoy@dobber.life. Dobber commits to responding within 14 days of receiving the notification.
3.1 The user agreement is concluded when the user fills in all requested information, accepts the general terms and conditions, and completes payment via the specified payment methods, or when the user makes use of Dobber's facilities.
3.2 The general terms and conditions and the user agreement together constitute the complete representation of the rights and obligations of Dobber and the user, and supersede all prior announcements, agreements, and correspondence.
3.3 The user ensures that all necessary data is provided to Dobber in a timely and complete manner. Dobber's privacy policy is available on the website via https://www.dobber.life/privacybeleid.
3.4 If the user purchases additional products or services from Dobber, the terms of the user agreement and these general terms and conditions remain applicable, unless otherwise agreed in writing.
3.5 Dobber reserves the right to unilaterally amend the general terms and conditions. Changes will be communicated and are deemed to have been agreed upon as soon as the user accepts the terms again during a subsequent reservation.
3.6 A user renting a kayak or SUP in their own name must be at least sixteen years old. The minimum age for users to participate in activities is 10 years, provided they possess a swimming certificate and sufficient swimming skills that can reasonably be expected when using a kayak or SUP. Users under 16 years of age must always be accompanied by a user who is over 18 years old.
4.1 Dobber processes the user's personal data in accordance with applicable privacy legislation.
4.2 Personal data requested and processed by Dobber includes, but is not limited to, the following information: name, email address, phone number, address, and date of birth.
4.3 This personal data will only be used for the execution of the agreement and will not be provided to third parties without the user's consent.
4.4 The processing of personal data by Dobber complies with the General Data Protection Regulation (GDPR) and Dobber's privacy policy, available at https://www.dobber.life/privacybeleid.
4.5 Dobber may create images for promotional purposes, unless the user explicitly objects.
5.1 The fees for individual rentals must be paid prior to use via the specified payment methods. A reservation is only confirmed upon receipt of payment.
5.2 Dobber reserves the right to change prices and rates. Users will be informed in advance of any price changes.
5.3 The prices on the Dobber platform are final prices including statutory VAT. The rates are as follows:

5.4 After payment, the user will receive a confirmation email with reservation information and instructions for picking up and using the equipment.
5.5 It is possible to reserve for multiple users simultaneously. The user making the reservation is responsible for the reservation and for opening the locker. For large groups, Dobber offers special activities and team-building events.
5.6 Discounts and promotions are subject to specific conditions as stated in the promotional communication.
5.7 Legal entities with a VAT number can request a VAT invoice at checkout.
6.1 Changes
6.1.1 Changes to a reservation can be requested up to 3 hours before the start of the session via the contact form on the Dobber website.
6.1.2 Changes are only possible if availability permits (such as type of vessel, location, time, or session duration) and will only be implemented after written confirmation by Dobber.
6.1.3 Dobber is not obliged to accept a change and may refuse a request without providing a reason.
6.1.4 If the change is confirmed in a timely manner and in writing, it will be processed free of charge.
6.1.5 Changes made within 3 hours before the start of the session will be refused as a standard policy. These do not entitle the user to compensation, a voucher, or a refund.
6.1.6 A reservation can be changed a maximum of once.
6.2 Cancellations
6.2.1 Cancellations requested more than 3 hours before the start of the session AND confirmed in writing by Dobber, entitle the user to a voucher equal to the original amount. This voucher is valid for 1 year and can be used for a new reservation.
6.2.2 Cancellations made within 3 hours before the start of the session will be refused and do not entitle the user to a voucher or refund.
6.2.3 In case of a no-show without cancellation, the paid amount will not be refunded, and no voucher will be issued. No additional charges will be applied.
6.2.4 A reservation can be cancelled a maximum of once.
6.3 All changes and cancellations are only valid after written confirmation by Dobber. The user must retain this confirmation as proof.
6.4 Dobber reserves the right to unilaterally cancel a reservation in case of double bookings, technical defects, safety risks, government measures, or extreme weather conditions (such as gusts of wind above 20 km/h, hailstorms, or cold snaps).
6.5 In case of cancellation by Dobber, the user will receive a full refund or a voucher, at their discretion. Refunds are made via bank transfer within 7 calendar days.
7.1 Discount Codes
7.1.1 Dobber may issue promotional discount codes as part of promotions, collaborations, or compensations.
7.1.2 Discount codes entitle the holder to a fixed discount or a percentage off the total amount of a reservation. The exact value and conditions are always stated separately upon issue.
7.1.3 Discount codes are only valid on the Dobber platform and can only be used once, unless otherwise stated.
7.1.4 Only one discount code can be used per reservation. Discount codes cannot be combined with other discount mechanisms such as benefit or season passes, unless explicitly stated otherwise.
7.1.5 Discount codes cannot be exchanged for cash, are not transferable, and lose their validity after the expiry date.
7.1.6 If a reservation paid (partially) with a discount code is cancelled, no new discount code will be issued unless otherwise agreed.
7.2 Gift Vouchers
7.2.1 Gift vouchers entitle the holder to a pre-paid value (e.g., €30, €50, €75, or €100) which can be freely spent on the Dobber platform, regardless of location, vessel, or session duration.
7.2.2 Gift vouchers are delivered digitally after online purchase and are valid for three years from the date of issue.
7.2.3 Gift vouchers can be used in one or multiple transactions, as long as sufficient balance is available. Any remaining balance remains active within the validity period.
7.2.4 Gift vouchers cannot be exchanged for cash or a partial refund in euros.
7.2.5 If a reservation paid with a gift voucher is cancelled, the amount will be made available again via a new gift voucher or voucher with the same validity period as the original balance.
7.2.6 For each reservation, only one gift voucher or discount code can be applied.
7.2.7 Gift vouchers are not nominative and are transferable. Dobber is not responsible for loss, theft, or unauthorized use.
7.3 Benefit Passes
7.3.1 A benefit pass is a digital multi-use pass entitling the holder to ten individual sessions with a solo kayak or SUP of the chosen duration (1 hour, 1.5 hours, or 2 hours), valid at all Dobber locations.
7.3.2 The benefit pass is valid for three years from the date of issue and automatically expires after this period with no right to a refund.
7.3.3 A maximum of one reservation can be made with a discount pass per calendar day, regardless of whose name it is booked under.
7.3.4 The discount pass may be shared, but it never grants the right to multiple simultaneous reservations or group use. If such use is detected, the pass will be blocked without any right to compensation.
7.3.5 The discount pass is exclusively valid for solo kayaks and SUPs. Use for duo kayaks or other formulas is excluded.
7.3.6 If a session is cancelled before it begins, the used credit will be re-allocated. Credits are not exchangeable or refundable in cash, either wholly or partially.
7.3.7 The processing and delivery of discount passes are done manually. The user will receive the pass via email within 24 hours of purchase.
7.4 Season Passes
7.4.1 A season pass grants unlimited use of a solo kayak or SUP for one season.
7.4.2 The validity period runs annually from April 1st to October 31st inclusive. After this period, the pass automatically expires without any right to a refund or extension.
7.4.3 The season pass is personal and non-transferable. Use by third parties is not permitted. Dobber reserves the right to block the pass without compensation in case of misuse.
7.4.4 Only one reservation can be made with a season pass per calendar day. Multiple reservations on the same day are excluded.
7.4.5 The season pass is valid at all Dobber locations in Belgium and can only be used for solo kayaks and SUPs. Duo kayaks and other formulas are excluded.
7.4.6 The holder has no priority regarding availability. Reservations are made based on availability, just like for all other users, via the regular platform.
7.4.7 If a session is cancelled before it begins, the right of use remains. No turn will be deducted or compensated.
7.4.8 The processing and delivery of the season pass are done manually. The user will receive the pass via email within 24 hours of payment.
7.5 Dobber for Life
7.5.1 Dobber for Life is a one-time purchase formula that grants the holder a lifelong right to a maximum of one free reservation per day with a solo kayak or SUP, valid at all Dobber locations in Belgium.
7.5.2 The formula is strictly personal and non-transferable. Transfer or inheritance is excluded. Dobber reserves the right to verify the user's identity with each reservation.
7.5.3 The right of use is valid as long as the "Dobber" concept is operational and includes solo kayaks and SUPs. If Dobber discontinues the entire offering within five years of purchase, a partial refund of €200.00 will be provided for each full remaining year.
7.5.4 The holder has no priority regarding availability. Reservations are made based on availability, just like for all other users, via the regular platform.
7.5.5 Dobber for Life is limited to the use of one vessel per day. Simultaneous use of both a kayak and a SUP, or multiple reservations on a single day, are not permitted.
7.5.6 In case of misuse or reasonable suspicion thereof (such as booking for third parties or simultaneous use), Dobber reserves the right to temporarily or permanently block the pass, without any right to compensation.
7.5.7 Access is manually activated and confirmed by email within 24 hours of payment. Upon activation, the user receives personal instructions on how to book using a voucher code.
8.1 A group reservation refers to any reservation for 10 or more participants that has been confirmed in writing by Dobber.
8.2 A reservation is only binding after written confirmation by Dobber. Verbal agreements or completed application forms do not count as confirmation.
8.3 Organizer's Responsibilities
8.3.1 The correct and timely payment of the full amount before the start of the activity.
8.3.2 Compliance with these terms and Dobber's safety guidelines by all participants.
8.3.3 Providing the final number of participants no later than 5 days before the start. Thereafter, this number is considered binding and will be fully invoiced, even in case of no-show or partial absence.
8.3.4 Requesting reconfirmation for changes in location, session duration, type of vessels, or start time. These are only valid after written reconfirmation by Dobber.
8.3.5 For groups with minors: providing at least 1 adult supervisor (18+) per 6 minor participants. Children under 10 years old may only participate in a tandem kayak under the direct supervision of a parent or adult in the same vessel.
8.4 Payment
8.4.1 Payment is made by invoice, before the start of the activity, in the name of the organizer or the entity that made the reservation. Payment via Peppol is possible upon request.
8.4.2 In case of non-payment by the due date, Dobber reserves the right to cancel the reservation without any right to compensation for the organizer.
8.5 Discounts
8.5.1 Dobber provides a group discount for recognized group reservations, according to the conditions stated in the confirmation. Other discounts, vouchers, or promotional codes are excluded, unless explicitly stated otherwise.
8.6 Change in number of participants
8.6.1 Up to 5 days before the activity: the number of participants can be adjusted free of charge.
8.6.2 Within 5 days before the activity: the confirmed number of participants remains fully due.
8.7 Cancellation of the activity
8.7.1 Up to 5 days before the start: the activity can be rescheduled to another date free of charge, provided it is requested in writing and confirmed by Dobber. A monetary refund is not possible.
8.7.2 Within 5 days before the start: the full anticipated amount will be invoiced. No compensation or refund is possible.
8.7.3 In case of cancellation due to force majeure on the part of the organizer (e.g., death, serious illness), each case will be assessed individually.
8.8 Cancellation by Dobber
8.8.1 Dobber reserves the right to refuse or cancel a group reservation in cases of force majeure, extreme weather conditions, safety risks, or violation of these terms.
8.8.2 In case of cancellation by Dobber, an alternative date or a refund will be offered.
8.9 Liability
8.9.1 The organizer is jointly and severally liable for damage to the equipment caused by group participants. The provisions of Article 10 apply in full.
8.9.2 By confirming a group reservation, the organizer agrees to Dobber's general terms and conditions. These can be consulted via www.dobber.life/voorwaarden and form an integral part of the reservation.
9.1 General Rules
9.1.1 The user declares to have informed themselves about the local rules for navigating and using the waterways, as provided by Dobber both online and offline in communication (https://qrco.de/bf5UZQ). The user commits to strictly adhere to these rules.
9.1.2 The user declares to be fit and healthy and to possess swimming skills that can reasonably be expected when using a kayak or SUP.
9.1.3 The minimum age to participate in activities is 10 years, provided one possesses a swimming certificate and has swimming skills that can reasonably be expected when using a kayak or SUP.
9.1.4 The minimum age to independently rent a kayak or SUP is 16 years. Persons under 16 years of age must always be accompanied by an adult.
9.1.5 The mere use of the kayak or SUP implies that the user declares to meet the above requirements. Business and private customers must ensure that all other group members also possess this personal suitability.
9.2 Safety
9.2.1 Kayakers are required to wear a life vest at all times.
9.2.2 SUP users must wear their safety leash around their ankle or leg at all times.
9.2.3 Dobber reserves the right to exclude participants who are under the influence of alcohol or drugs from participation.
9.2.4 In serious emergencies, the user must call emergency services (112) and then inform Dobber via the hotline (0466903285).
9.3 Equipment Use
9.3.1 Upon receipt, the user must inspect the rented equipment for damage and report any damage immediately. If Dobber does not receive a report within the first 10 minutes of the session, it will be assumed that the equipment is in good condition and ready for use.
9.3.2 Damage to equipment caused by the user must be reported before the end of the session. Damage exceeding normal wear and tear must be compensated.
9.3.3 The equipment must be handled with care and returned neatly to the locker within the agreed rental period.
9.3.4 Equipment refers to the entire contents of the locker, which varies by activity type:
9.3.5 If the user cannot return the equipment on time, this must be reported immediately via 0466903285, so that Dobber can inform the next user.
9.3.6 For late returns, a fee of €10.00 per commenced half hour per locker will be charged. Access to the locker will only be granted after payment of this fee.
9.3.7 The user is liable for all consequential damages, including any refunds to other users who have to cancel their reservation due to late return.
9.4 Handling Damage and Loss
9.4.1 If users cannot start their sessions because equipment is missing or damaged, Dobber will provide a replacement. If this is not possible, the user may withdraw from the contract or demand a price reduction.
9.4.2 Users must secure their valuables against loss and water damage. Electronic devices must be stored in the designated waterproof bag. Dobber is not responsible for loss or damage to personal belongings.
9.4.3 The last user is responsible for damage to or loss of equipment (all items listed in 9.4.5). From the moment the first 10 minutes of your session have passed, you become the last user of the equipment. Until the next user confirms the equipment is in order, you are responsible for any damage or loss.
9.4.4 For groups, the user who made the reservation is responsible for payment and further settlement of the compensation.
9.4.5 Costs for loss or damage: If equipment is lost or damaged due to user's actions, the user is liable for the costs of replacement or repair. The amounts listed below are applied as a fixed compensation per item:
9.5 Rules of Conduct on the Water
9.5.1 Users are required to use the designated Dobber entry and exit points for the water. These are always clearly indicated on the location page.
9.5.2 Users must always give way to vessels, as they have limited visibility and cannot stop quickly.
9.5.3 Users must always keep to the right, both when navigating and when passing oncoming traffic. Waterways must be crossed directly and smoothly to avoid dangerous situations.
9.5.4 Users must avoid locks intended for large vessels. The water must be exited at the designated spots, and locks must be crossed on foot.
9.5.5 Users must check the weather before departing and should never go on the water during strong gusts of wind or stormy weather.
9.5.6 Users must respect nature by not leaving any litter and by observing wild animals from a distance.
9.5.7 Users are not permitted to urinate in public. Public restrooms and catering establishments are available. If necessary, please ask for the location of these facilities.
9.7 Pets
9.7.1 Pets such as dogs are allowed on the kayak or SUP, but the owner is always, and without exception, responsible for injuries or damage to the equipment, the animal, or third parties.
10.1 The use of Dobber facilities, including kayaks and SUPs, is entirely at the user's own risk. The user accepts the risks associated with kayaking and SUPing, including potential drowning risks.
10.2 The user is responsible for the rented equipment and must treat it with care and diligence. Any defects must be reported immediately upon receipt. Damage to the equipment, caused by the user or third parties, must be reported and compensated before the end of the session.
10.3 The user is liable for all damage to the rented equipment and for damage caused to third parties by the use of the rented equipment. Dobber accepts no liability for material and non-material damage, loss, or theft of property belonging to users and/or third parties.
10.4 For group rentals, the user who made the reservation is liable for damage caused by co-users. Pets are allowed on the kayak or SUP, but the user is always responsible for damage to the equipment, the animal, or third parties.
10.5 The user declares to comply with all applicable laws and regulations when using the rented equipment. In case of violation, the user indemnifies Dobber against all claims, damages, costs, or interest arising from the unlawful use of the products or services.
10.6 The use of the equipment under the influence of alcohol or other intoxicating substances is prohibited. Dobber is not liable for any damage resulting therefrom.
10.7 Dobber is responsible for the proper functioning of the SUP & Kayak vending machine and for providing quality, safe equipment and clear usage instructions. Dobber accepts no liability for incidents during the transport, use, or other manipulation of the equipment outside the direct sphere of influence of the vending machine.
10.8 Dobber is only liable for dereliction of duty if, according to legal provisions, intentional or grossly negligent conduct of its auxiliary persons or legal representatives is attributable. In such cases, Dobber is liable up to the amount paid out by the insurer. Dobber is never liable for indirect damage, consequential damage, non-material damage, or business damage, but makes maximum efforts to guarantee safety and limit damage where possible.
10.9 The exclusions and limitations of liability as stated in this article also apply to Dobber's employees and anyone else whose assistance Dobber uses in the performance of the participant agreement.
10.10 Claims for damages by users expire one year after they arise, except for claims due to intentional and gross negligence.
10.11 Dobber provides recreational kayaks and SUPs suitable for users up to a body weight of approximately 100 kg. Users who exceed this or doubt their stability or physical fitness participate at their own risk. Dobber does not guarantee individual stability based on physique, experience, or usage habits.
10.12 It is the user's responsibility to check the suitability and safety of the equipment before the start of the session. If the equipment feels unsuitable or unsafe, the user must immediately stop the activity and contact Dobber. By using the equipment, the user accepts the equipment in the condition in which it was offered.
11.1 Complaints must be submitted to Dobber within a reasonable time, fully and clearly described.
11.2 Complaints will be answered within 14 days. In case of a longer processing time, the user will be informed.
12.1 Dobber is not liable for any delay, damage, or detriment resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, fire, floods, strikes, riots, terrorism, war, government measures, technical malfunctions, or transportation problems.
12.2 If Dobber is unable to fulfill its obligations due to force majeure, it will immediately inform the user and make reasonable efforts to amend or cancel the rental agreement, without incurring any liability for Dobber.
12.3 The user understands and accepts that force majeure situations are unpredictable and beyond Dobber's control. Dobber will make reasonable efforts to assist the user in finding an alternative solution in the event of force majeure.
12.4 Termination of the agreement due to weather conditions preventing the performance of the service (including but not limited to wind gusts above 20 km/h, hailstorms, or a cold snap) can be discussed as an option in advance and can occur without additional costs.
13.1 If any provision of these general terms and conditions is declared wholly or partially invalid, void, or unenforceable by a competent court or authority, the remainder of the general terms and conditions shall remain in full force and effect.
13.2 The parties shall negotiate in good faith to replace the invalid or unenforceable provision with a valid and enforceable provision that approximates the original intent of the invalid provision as closely as possible.
13.3 This severability clause is intended to ensure the validity and enforceability of the general terms and conditions, even if individual clauses prove to be invalid or unenforceable.
13.4 In the event of legal changes, court rulings, or other circumstances that render a provision invalid or void, the parties commit to jointly agree, in good faith, on a new provision that approximates the meaning and purpose of the invalid provision as closely as possible.
14.1 These terms and conditions are governed by Belgian law.
14.2 Disputes shall be submitted to the competent court in Belgium, with the courts in Ghent having exclusive jurisdiction.
14.3 In the event of disputes, both parties shall first attempt to reach a solution through negotiations. If an amicable settlement is not reached, the dispute shall be submitted to the competent court in Ghent.
15.1 These general terms and conditions are drawn up in Dutch. In case of discrepancies between translations, the Dutch version is legally binding.
